The Federal High Court, Abuja, on Wednesday, adjourned hearing of a suit seeking to disqualify Mr Osagie Ize-iyamu from the Sept. 19 governorship election in Edo until Oct. 14.
The suit was filed by the Peoples Democratic Party (PDP) against the Independent National Electoral Commission (INEC), the All Progressives Congress (APC) and Ize-Iyamu and was slated for hearing on Oct. 16.
However, at the resumed hearing, counsel to the PDP, Mr Ken Mozia (SAN) informed the court that the APC filed an application challenging the judge’s sitting during vacation.
Mozia said that since the vacation was almost over, the matter should be adjourned to a date after vacation.
For his part, counsel to the APC, Mr Akinlolu Kehinde informed the court that he was served with an application of Ize-Iyamu asking the court to compel Hilary Otsu to appear in court, and he needed to respond to it.
Ize-Iyamu said Otsu deposed to an affidavit in support of the plaintiff’s processes and his team would like to cross examine him on the contents of the affidavit.
Counsel did not oppose to the application to adjourn the matter to a date after vacation and the judge adjourned the matter until Oct. 14.
PDP is seeking the disqualification of Ize-Iyamu on the grounds that he was not a product of a valid primary election of the APC.
