The National Industrial Court, Abuja on Thursday summoned the legal advisers of Civil Defence, Correctional, Fire, and Immigration Services Board ( CDCFIS) and the Nigerian Immigration Services ( NIS), to appear before it.
The court summoned the legal advisers to appear before it to give reason why the Minister of Interior, Rauf Aregbesola as Chairman of its board and the Comptroller-General of NIS, Muhammed Babandede should not be committed to jail for not complying with court’s order.
The Judge, Justice Rakiya Haastrup, made the order after listening to the application of the judgment of creditor’s counsel, Femi Adedeji.
Adedeji in his application had prayed for the order of committal against the judgment debtors, (Chairman, CDCFISB, NIS and CG, NIS):pursuant to Notices in Form 48 and 49 of the Sheriffs and Civil Process Act.
According to the judge ” from the records of the court, it is observed that the judgment debtors are yet to comply with the orders of this court made on March 29,2019 and this is quite worrisome”.
Haastrup further said she noted Adedeji’s application and the fact that the judgment debtors had not complied with the orders earlier made in the judgment.
She, therefore, ordered that the legal advisers should explain the reason the orders had not been complied with and why the Chairman of the board and the NIS CG should not be committed to jail for not complying with the orders.
The judge equally directed that the order and summons be duly served on the legal advisers to appear before the court and adjourned the case until Dec. 14, for hearing.
The judgment delivered on March 29, 2019 that had not been complied with, ordered that the judgment debtors immediately align the rank of an ex-staff, Made Oguntoyinbo to Comptroller of Immigration.
The judgment held that Oguntoyinbo proved his case that he was denied promotion several times by the judgment debtors and when he was eventually allowed to participate in 2015 promotion examination exercise, his result was never released.
The judgment further ordered that the judgment debtors immediately release his result in the said promotion exercise and align his rank to that of Comptroller of Immigration (CIS) like his contemporaries that he joined the service with.
Another order made by the court which had not be complied with was the order of payment of the sum of N9.7million as his salary arrears.
The court in the judgment also directed the judgment debtors to pay Oguntoyinbo the sum of N2million as general damages and awarded the sum of N250, 000 to him as cost of prosecuting the suit.
