An Abuja High Court presided over by Justice Danlami Senchi
awarded a cost of ten million naira against Arik Air for infringing on the right of Doctor Isa Modibbo, a passenger whose flight was delayed from 10.30am to 6.00pm on Dec. 16, 2017.
Senchi in his judgment sent a strong warning to airline operators to respect the rights of passengers.
While delivering judgment in the suit filed by Modibbo, the court held that the failure of the airline to fulfil its contractual obligation of airlifting the plaintiff to Sokoto from Abuja at the stipulated time indicated on the flight ticket is a serious breach of contract and infringement of the plaintiff’s right to free movement.
Justice Senchi in his judgment explained that the failure of the airline to respond to the request of the plaintiff for compensation amounts to willful infringement and sheer arrogance which must not be allowed to continue.
It also mandated the airline to pay the sum of N50,000 as cost of instituting the suit to the plaintiff’s lawyer.
Doctor Modibbo who suffers from Diabetes is said to have missed his appointment with his Doctor in Sokoto after inviting him from Niger Republic.
